Boat Connection Sales and Service is not responsible for loss or damage to above described product or for articles left in or with product in case of fire, theft, accident, inclement weather conditions or any other cause beyond our control.

I hereby authorize the above repair work to be done along with the necessary material, and hereby grant you and/or your employee permission to operate the product herein described on any waterway or elsewhere for the purpose of testing and/or inspection. An express mechanics lien is hereby acknowledged on above product to secure the amount of repairs.

The Boat Connection Sales and Service INC., a Florida corporation, hereinafter referred to as the seller, is not responsible for the condition of the customer’s boat brought to the seller’s dealership for service. The seller is specifically not liable for any defects in the transom, stringers, and/or overall structural integrity of the customer’s boat. Furthermore seller is in no way responsible if the customer chooses to overpower the vessel over and above applicable Coast Guard/ manufacturer’s recommended specifications. The seller is exclusively not liable for any personal injury or property damage that may come about as a result of the condition of the buyer’s vessel when presented to the seller for service.

Seller is not responsible to the buyer for any goods that have been subject to misuse, negligence or accident, and may have been altered or repaired by persons other than the seller in any respect, which in the judgment of the seller affects the condition or operation of the goods. Seller makes no warranty of any kind, express or implied, except that the goods sold under the agreement and the labor performed shall be of standard quality of the seller and buyer assumes all risk and liability resulting from the use of the goods, whether used slightly or in combination with other goods, seller neither assumes nor authorizes any person to assume for seller any oral agreements or warranties collateral to or affecting this agreement.

Seller warrants the materials provided to the buyer against defects, but makes no other warranties, express or implied, unless the word “guarantee” is used. Warranties of merchantability and of fitness for a particular purpose, or arising from a course of dealing or usage of trade are specifically excluded. Any affirmation of fact, description of goods or sample or model referred to in the agreement, whether or not the same relate to production or capability of the goods to perform, are not the basis of this agreement unless the word “guarantee” is used in connection therewith, in which case, affirmation, description, sample, or model shall be an express warranty. Seller makes no warranty of operation or efficiency except thos warranties that may be stated in this agreement, which are expressly limited to the goods sold and the service performed.

Although Boat Connection Sales and Service INC. will be placing your vessel within a secure facility while awaiting repairs, The Boat Connection Sales and Service INC. will not be held responsible for any theft, acts of nature, fire or vandalism. The owner of the vessel must have insurance that is effective or be personally held responsible for any of the above mentioned occurrences.

PLEASE TAKE TRAILER LOCKS, TRAILER WIRING ADAPATORS FOR LIGHTS AND ANY OTHER PIECES THAT MAY GET LOST WITH YOU. WE ARE NOT RESPONSIBLE FOR LOST TRAILER PARTS OR TRAILER LOCKS THAT NEED TO BE CUT.
